TERMS OF USE, SERVICE AGREEMENT & PRIVACY POLICY

NOTICE TO ALL USERS: These Terms of Use, together with the Service Agreement and Privacy Policy set forth herein (collectively, the "Terms"), constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you," "User," or "Customer"), and HostPager (the "Company," "we," "us," or "our"), concerning your access to and use of the hostpager.com website, control panel, application programming interfaces, design studio, artificial intelligence tooling, hosting infrastructure, domain registration and resale services, blockchain publishing services, and any related media, channels, software, or applications made available by the Company (collectively, the "Service"). BY ACCESSING, BROWSING, REGISTERING FOR, PURCHASING, OR OTHERWISE USING THE SERVICE IN ANY MANNER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY ALL OF THESE TERMS. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND MUST DISCONTINUE USE IMMEDIATELY.

1. Description of the Service and How It Operates

1.1. The Company provides a web hosting and site-creation platform through which Users may (a) purchase recurring virtual private server hosting packages of varying storage allocations; (b) search for, register, and manage internet domain names through third-party registrar partners; (c) design, generate, edit, and deploy websites and web applications by means of an integrated artificial-intelligence design studio; (d) generate, modify, resize, reformat, and otherwise manipulate images by means of third-party artificial-intelligence image models; (e) publish website content permanently to a public distributed ledger; and (f) connect external artificial-intelligence assistants to a User's site through a tokenized machine-readable interface.

1.2. The design studio operates by transmitting the User's textual instructions, together with contextual information concerning the User's existing site files, to one or more third-party large language model providers. The model returns generated file contents which the Service writes into the User's allocated storage. Image generation operates analogously by transmitting a textual prompt to a third-party image model and writing the returned image into the User's storage.

1.3. Consumption of artificial-intelligence functionality is metered in units denominated as "design credits." Credits are purchased in advance and are decremented according to the quantity of input and output consumed, as reported by the applicable model provider, charged at the rates then in effect and published by the Company. Where a provider does not report consumption for a given request, the Company determines the chargeable quantity by a reasonable method of its choosing. Image generation and distributed-ledger write operations are decremented at the per-operation rates then in effect. Rates are subject to change as provided in Section 4. Credits possess no cash value, are not a deposit, bear no interest, are non-transferable between accounts, and are not redeemable for currency.

2. Artificial Intelligence: Nature, Limitations, and User Responsibility

2.1. The Service is substantially designed, operated, supported, and delivered through artificial-intelligence systems. The Company is a small organization and relies extensively upon automation to provide functionality, integrations, and support at a cost substantially below that of conventionally staffed providers. The low pricing of the Service is a direct consequence of this operating model, and by using the Service you accept the tradeoffs inherent in it.

2.2. ARTIFICIAL INTELLIGENCE SYSTEMS MAKE MISTAKES. Output generated by the Service, including without limitation website code, markup, styling, scripts, configuration, textual copy, imagery, and any recommendations or explanations, may be inaccurate, incomplete, non-functional, insecure, aesthetically unsatisfactory, legally noncompliant, infringing of third-party rights, or otherwise unfit for any particular purpose. Generated output may contain errors, fabricated statements, broken functionality, or security vulnerabilities. The Service does not guarantee that generated output will function as intended, will be free of defects, or will meet your requirements.

2.3. You are solely and exclusively responsible for reviewing, testing, validating, correcting, and approving all output before publishing, deploying, distributing, or otherwise relying upon it, and for ensuring that any published material complies with all laws applicable to you and to your audience. You assume all risk arising from your use of or reliance upon artificial-intelligence-generated output.

2.4. Model providers, model versions, model capabilities, and model availability may change, degrade, or be discontinued at any time without notice, including where such changes are outside the Company's control.

3. Hosting Modalities: Conventional Hosting and Blockchain Publishing

3.1. Conventional (Cloud/VPS) Hosting

Conventional hosting packages are billed on a recurring monthly basis and allocate a defined quantity of storage on Company-operated infrastructure. Files are stored on Company infrastructure and served from a containerized environment dedicated to the User's package. Recurring packages remain active only so long as fees are paid when due. Non-payment may result in suspension, and continued non-payment may result in termination and deletion of stored data. Users are solely responsible for maintaining independent backups of all content.

3.2. Blockchain ("On-Chain") Publishing

3.2.1. On-chain publishing permits a User to record a snapshot of a website to a public, permanent, distributed storage network, with a corresponding pointer transaction recorded to a public blockchain. On-chain publishing is charged on a per-deployment basis, calculated as a multiple of the then-current network storage cost for the exact byte size of the deployment plus applicable network transaction fees, and carries no recurring monthly hosting charge.

3.2.2. DATA WRITTEN TO A PUBLIC DISTRIBUTED LEDGER OR PERMANENT STORAGE NETWORK IS IMMUTABLE AND CANNOT BE DELETED, ALTERED, RECALLED, OR REDACTED BY THE COMPANY OR BY ANY OTHER PARTY, INCLUDING YOU. Once published, a deployment persists indefinitely and is publicly retrievable by any person in encrypted form. You must not publish any content that you may later need to remove, including without limitation personal data of third parties, confidential information, credentials, or material subject to deletion rights. The Company cannot honor deletion requests with respect to data already committed to such networks, and no right of erasure can be exercised against an immutable ledger.

3.2.3. On-chain deployments are encrypted at rest prior to transmission using per-site keys held by the Company in escrow for the purpose of resolving and serving the site. You acknowledge that the Company therefore possesses the technical ability to decrypt on-chain site content, and that such encryption protects against casual third-party inspection of the ledger but does not render content inaccessible to the Company.

3.2.4. Each deployment constitutes a distinct immutable version. Users may designate any previously published version as the version served. Reverting between existing versions does not incur additional storage charges; each new deployment does.

3.2.5. On-chain packages do not include continuously running compute. Editing environments for on-chain packages are provisioned on demand and are reclaimed after a period of inactivity. Content that has not been published to the ledger prior to reclamation may be irretrievably lost. You are solely responsible for publishing work you wish to preserve.

3.2.6. Network storage costs, transaction fees, and cryptocurrency valuations fluctuate. Quoted charges reflect conditions at the moment of quotation and may differ materially at the moment of execution.

4. Fees, Billing, Rate Changes, and Payment

4.1. ALL PRICES, RATES, MULTIPLIERS, CREDIT DENOMINATIONS, PER-TOKEN CHARGES, PER-IMAGE CHARGES, PER-DEPLOYMENT CHARGES, AND RECURRING FEES ARE SUBJECT TO CHANGE AT ANY TIME, WITHOUT PRIOR NOTICE, AT THE SOLE DISCRETION OF THE COMPANY. Continued use of the Service following any such change constitutes acceptance of the revised rates.

4.2. Payments may be accepted in fiat currency via third-party payment processors and in digital assets via supported blockchain payment rails. The Company does not custody User payment card data. Digital-asset transactions are irreversible; the Company cannot reverse, refund, or recover a transaction submitted to an incorrect address, in an incorrect amount, on an incorrect network, or without a required reference identifier.

4.3. Except where required by applicable law, all fees are non-refundable, including without limitation credits consumed by artificial-intelligence operations, fees expended on irreversible blockchain write operations, and domain registration fees, which are non-recoverable once submitted to a registrar.

4.4. Domain registrations, renewals, and transfers are subject to the policies of the applicable registry and registrar and to ICANN requirements. Failure to renew may result in expiration, redemption fees, or loss of the domain. The Company is not liable for any loss arising from domain expiration, registrar action, registry action, or third-party acquisition of a lapsed domain.

5. Privacy Policy and Data Handling

5.1. The Company does not sell, rent, lease, license, trade, or otherwise monetize User personal information to or with third parties for advertising or marketing purposes. The Company does not operate an advertising network and does not permit third parties to profile Users through the Service for advertising purposes.

5.2. The Company collects only such information as is reasonably necessary to provide the Service, including account identifiers, authentication credentials in salted and hashed form, billing records, domain records, package configuration, usage metering data, and operational logs.

5.3. Data is encrypted in transit using industry-standard transport-layer security and is encrypted at rest. Design studio conversation transcripts are encrypted at rest with per-account keys and are not served publicly. Provider API credentials and wallet seed material held by the Company are encrypted at rest using authenticated encryption.

5.4. To provide artificial-intelligence functionality, User prompts and relevant site content are transmitted to third-party model providers, which process such data under their own terms and privacy policies. Users should not submit sensitive personal data, protected health information, payment card data, government identifiers, or trade secrets to the design studio.

5.5. Where a User enables a tokenized external-assistant connection, any party possessing the resulting access token may read and modify that site. Users are solely responsible for safeguarding such tokens, disabling access when not in use, and rotating tokens as appropriate.

5.6. The Company may disclose information where required by law, subpoena, court order, or governmental request, or where necessary to protect the rights, property, or safety of the Company, its Users, or the public.

5.7. Data stored on Company infrastructure may be deleted following account termination or package cancellation. Data committed to public distributed networks cannot be deleted, as set forth in Section 3.2.2.

6. Acceptable Use

6.1. You shall not use the Service to store, publish, transmit, or distribute material that is unlawful; that infringes any intellectual-property right; that constitutes malware, phishing, or fraudulent content; that depicts the sexual exploitation of minors; that harasses, threatens, or defames any person; that facilitates the distribution of unsolicited bulk communications; that violates export-control or sanctions laws; or that unduly burdens, degrades, or attempts to circumvent the security, quotas, metering, or access controls of the Service.

6.2. You shall not attempt to circumvent credit metering, obtain artificial-intelligence functionality without payment, access another User's data, or reverse engineer the Service except to the extent such restriction is prohibited by law.

6.3. The Company may suspend or terminate any account, and may remove or refuse to serve any content, for violation of this Section, without notice and without refund.

7. User Content and Intellectual Property

7.1. You retain ownership of content you upload. You grant the Company a limited, non-exclusive, worldwide, royalty-free license to store, reproduce, transmit, encrypt, publish, and display such content solely as necessary to operate the Service at your direction, including publishing to public distributed networks where you so instruct.

7.2. Ownership of artificial-intelligence-generated output is subject to the terms of the applicable model provider and to unsettled questions of law. The Company makes no representation that generated output is protectable, original, or non-infringing.

7.3. You represent and warrant that you possess all rights necessary to publish the content you submit and that such content does not infringe any third-party right.

8. Service Availability; Disclaimer of Warranties

8.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS, AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.

8.2. THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF DATA LOSS; THAT GENERATED OUTPUT WILL BE ACCURATE OR FUNCTIONAL; THAT ANY DEFECT WILL BE CORRECTED; OR THAT THIRD-PARTY PROVIDERS, REGISTRARS, PAYMENT PROCESSORS, STORAGE NETWORKS, OR BLOCKCHAIN NETWORKS WILL REMAIN AVAILABLE, SOLVENT, OR OPERATIONAL. NO UPTIME COMMITMENT, SERVICE-LEVEL AGREEMENT, OR SUPPORT-RESPONSE COMMITMENT IS PROVIDED UNLESS SEPARATELY EXECUTED IN WRITING.

8.3. The Company is not responsible for loss, corruption, or unavailability of data. You are solely responsible for maintaining independent backups.

9. Limitation of Liability

9.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY OR ITS OFFICERS, PRINCIPALS, CONTRACTORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, BUSINESS OPPORTUNITY, DATA, OR DIGITAL ASSETS, ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.2. THE AGGREGATE LIABILITY OF THE COMPANY FOR ANY AND ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO THE COMPANY IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100.00).

9.3. Certain jurisdictions do not permit the exclusion of implied warranties or limitation of certain damages; in such jurisdictions the foregoing shall apply to the fullest extent permitted.

10. Indemnification

You agree to defend, indemnify, and hold harmless the Company from and against any claim, demand, loss, liability, damage, cost, or expense, including reasonable attorneys' fees, arising out of or relating to your content, your use of the Service, your publication of material to any public network, your violation of these Terms, or your violation of any right of a third party.

11. Term, Suspension, and Termination

The Company may suspend or terminate your access at any time, with or without cause and with or without notice. Upon termination, your right to use the Service ceases immediately, data on Company infrastructure may be deleted, unused credits are forfeited except where prohibited by law, and content previously committed to public networks remains permanently published.

12. Modification of Terms; User's Continuing Obligation

12.1. The Company reserves the right, in its sole discretion, to amend, modify, supplement, or replace these Terms at any time and without individual notice. Revised Terms are effective immediately upon posting.

12.2. IT IS YOUR SOLE RESPONSIBILITY TO PERIODICALLY REVIEW THESE TERMS AS POSTED AND TO REMAIN INFORMED OF ALL MODIFICATIONS. YOUR CONTINUED ACCESS TO OR USE OF THE SERVICE FOLLOWING THE POSTING OF ANY REVISION CONSTITUTES YOUR ACCEPTANCE OF, AND AGREEMENT TO BE BOUND BY, THE REVISED TERMS. If you do not agree to any revision, your sole remedy is to discontinue use of the Service.

13. Third-Party Services

The Service integrates third-party model providers, payment processors, domain registrars, blockchain networks, and permanent-storage networks. The Company does not control and is not responsible for the acts, omissions, pricing, availability, security, or policies of such third parties, and disclaims all liability arising therefrom.

14. Blockchain and Digital Asset Risk Acknowledgment

You acknowledge that distributed-ledger technologies carry inherent risks including network congestion, fee volatility, protocol changes, forks, consensus failure, key loss, irreversible transactions, regulatory action, and total loss of value or access. The Company does not provide financial, investment, tax, or legal advice, and nothing in the Service constitutes such advice.

15. General Provisions

15.1. Entire Agreement. These Terms constitute the entire agreement between the parties concerning the Service and supersede all prior understandings.

15.2. Severability. If any provision is held unenforceable, that provision shall be modified to the minimum extent necessary and the remaining provisions shall remain in full force.

15.3. No Waiver. No failure or delay in exercising any right shall constitute a waiver of that right.

15.4. Assignment. You may not assign these Terms without the Company's prior written consent. The Company may assign freely.

15.5. Force Majeure. The Company shall not be liable for any failure or delay resulting from causes beyond its reasonable control.

15.6. Governing Law and Venue. These Terms are governed by the laws of the State of Connecticut, United States, without regard to conflict-of-laws principles, and the parties submit to the exclusive jurisdiction of the state and federal courts located therein.

15.7. Electronic Communications. You consent to receive communications electronically and agree that electronic records satisfy any legal requirement that communications be in writing.

15.8. Eligibility. You represent that you are at least eighteen (18) years of age and capable of forming a binding contract.

BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS IN THEIR ENTIRETY, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM.
